What You Should Know
An offense committed against an intimate partner or family member may be labeled a domestic violence crime in Colorado. By itself, "domestic violence" is not a charge but is attached to an existing crime, such as assault, because it took place in a domestic setting. A domestic violence charge means that the accused threatened to or actually carried out an act of violence against a spouse, ex-spouse, dating partner, or intimate partner. Included in domestic violence crimes are harassment, stalking, intimidation, coercion, or any crime in which force is threatened or the victim fears for his or her life.
When law enforcement is called to the scene of domestic violence, if they believe that a crime has been committed, they are required to arrest the suspect without delay. Once you are arrested for a domestic violence crime, you will be taken into custody and booked. Even if your accuser later denies that a crime took place or never wants you arrested in the first place, the domestic violence charge will proceed unless the District Attorney decides that it shouldn't. What the victim says has no bearing on this decision. Domestic crime charges can also be enhanced from misdemeanors to felonies in cases of prior convictions and penalties can be made more severe with additional terms, such as batterer evaluation and treatment. Domestic violence crimes can also lead to restraining orders, can affect child custody, and negatively affect your future as you will be labeled a domestic violence offender.
