A 43-year-old woman was taken into custody recently after reportedly leaving her baby and dog unattended in her car. Police were called to the parking lot of a local Lowe's store when witnesses stated that a baby and a dog were left locked inside a car with the windows slightly rolled down. Officers arrived on the scene shortly thereafter at about 7:20 in the evening. They observed the 7-month-old baby and located the child's mother in the store. The woman, K.K., unlocked the vehicle and her baby was taken to a local medical facility for evaluation. Reports do not specify the baby's or the dog's condition at the time. The temperature was reported to be about 98 degrees Fahrenheit when the incident occurred. K.K. was taken into custody and released the next morning after posting $10,000 bail. She has been charged with felony child abuse.
Consult with a criminal defense lawyer now if you have been charged with a felony offense such as child abuse. A felony conviction has much more harsh sentencing than a misdemeanor and can include many years in prison, thousands in fines, lengthy probation and other penalties depending on the specific circumstances. Child abuse charges may be brought against someone if the child was allegedly placed in a situation that could endanger the child's life or health, if he or she was exposed to the inclemency of the weather or if the child was tortured, cruelly confined or cruelly punished (Section 30-6-1 of the New Mexico Statutes and Codes). Judges have some discretion when it comes to sentencing felonies so they can take into account what they view as being proper punishment for the alleged crime. A child abuse conviction could result in anything from 18 months to 18 years in prison and $5,000 to $15,000 in fines.
