Drunk Driving Consequences in New Mexico

In the state of New Mexico, it is against the law to drive if you have a blood alcohol concentration (BAC) of .08 percent or more if you are over the age of 21. For commercial drivers, it is illegal to drive with a BAC of .04 percent or more. For drivers under the age of 21, it is illegal to drive with a BAC of .02 percent or more. You can also be arrested and charged with a DWI in the state even if your BAC is below the legal limit if you demonstrate an impaired ability to operate a motor vehicle due to alcohol and / or drugs. If your BAC measures .08 percent or above or if you refuse to submit to a chemical test, you will face the prospect of losing your driver's license, for a period of up to a year.
According to the New Mexico MVD, alcohol plays a part in approximately 40 percent of those traffic accidents in the state where someone is killed. Because of the serious dangers that drunk and drugged driving imposes on the safety of all drivers, their passengers, motorcyclists, bicyclists, and pedestrians, law enforcement is ever on the lookout for and aggressively pursues those who violate the law. On a first conviction, you can expect to pay hefty fines and court costs and run the risk of being incarcerated. Alcohol and / or drug treatment may be imposed. You will be required to install and use, at your own expense, an ignition interlock device once you are allowed to drive again. After your arrest, you will have 10 days to request an administrative hearing challenging your automatic license suspension.
