Albuquerque Man Sentenced after Vehicular Homicide Conviction

M.S. recently received his sentence after being convicted of vehicular homicide stemming from a fatal DUI incident. The crash occurred in August of last year when M.S. was reportedly driving his pickup truck while under the influence of alcohol. His truck hit another car which had a two-year-old boy in the back seat. He then attempted to flee the scene by going the wrong way at which point he struck a police cruiser. Officers caught up to the man, stopped him and took him into custody. Arrest reports state that M.S. took a breath test on a portable breathalyzer machine and registered a 0.16 percent blood alcohol concentration (BAC)—twice the legal limit. The little boy received a severe brain injury in the crash and was on life support for a week before family decided to take him off. He died shortly thereafter. Have you been charged with DUI? M.S. was initially charged with hit and run and DUI involving serious injury. He posted bond and was released pending his court hearing. He was arrested again days later when the two-year-old died. The charges against him were increased at that time to vehicular homicide. The new charges doubled the possible prison time to six years. He was convicted of the serious charge against him and recently sentenced to the maximum penalty of six years' incarceration. M.S. expressed his apologies to the little boy's family and said he will be speaking to high school students about the dangers of drinking and driving.
