Texas Man Sentenced in Pornography Case

A South Texas man has been given a prison sentence of nine years after being convicted by a federal judge in a child pornography case. The 31 year-old man was sentenced in a Corpus Christi court for texting the pornographic images to a cell phone that he believed belonged to a young female co-worker. The cell phone actually belonged to a male relative of the young co-worker. After receiving the unsolicited images on his cell phone, the male relative contacted law enforcement officers which led to the defendant's arrest and criminal case. The South Texas man who was convicted pleaded guilty to the charges of possessing and sending the pornographic images.
The possession and distribution of child pornography is a crime under both Texas state law as well as federal law. In Texas, child pornography involves images of anyone under the age of 18 that are of a sexual nature. Texas law prohibits the promotion, creation, or dissemination of any such materials whether they are photographic images, videos, or any other type of visual representation. The possession of child pornography is charged as a third degree felony in Texas. Where the defendant had intent to promote or distribute it, as in the case above, it is charged as a second-degree felony. In 2011, Texas changed the laws regarding "sexting" by minors. Sexting refers to sending and receiving sexually explicit images by cell phone text. Those who violate the laws for the first time regarding this crime who are under 18 are charged with a Class C misdemeanor as opposed to a felony.
