In what appears to have been a gang-related crime, a 17 year-old has been charged with murder in the fatal stabbing of another student at Spring High School in Houston on September 4th. According to the Harris County Sheriff's Office, a 17 year-old was killed and three others were injured in the incident. The student who was charged with the killing is being held in the Harris County jail. The killing took place when a fight broke out between the various students in a hallway of the school. The accused killer apparently admitted the stabbing to the Sheriff's Office deputies. Under Texas law, those aged 17 are considered to be adults and thus face the same legal consequences as an adult in the criminal justice system.
The Texas juvenile justice system applies to minors aged 10 through 16. When a juvenile in this age group breaks the law, he or she is taken to a juvenile detention center. Where charges are filed against a juvenile, a court investigation is begun by a probation officer. A detailed evaluation is made of the juvenile's behavior, background, and social relationships which is then forwarded to the judge who will oversee the case. The court proceeding in a juvenile case is called an adjudication hearing. The juvenile, his family, and his attorney appear before the judge or a jury who decides whether or not a crime has been committed and how it should be handled. In cases where a juvenile aged 14 or older has committed a felony, he or she may be "certified" as an adult and transferred to the adult criminal justice system.
