Even Lawmakers Get DUIs

A Democratic State Representative from Duluth, Minnesota was charged with DUI in February of this year. The legislator, T. H., was pulled over by a Minnesota State Patrol officer for speeding; he was driving approximately 8 miles per hour over the posted limit. After being stopped, he was given a breath test by the officer. The test resulted in a .083 blood alcohol concentration which is slightly over the legal limit of .08 percent. The legislator was given a warning but not ticketed for speeding and stated publicly that he would not fight the DUI. He also apologized publicly to the people of Duluth. The 71 year-old legislator is the chairman of the House Health and Human Services Finance Committee.
A first-offense DUI in Minnesota carries penalties of up to 90 days in jail, a fine of up to $1,000, a license suspension of up to 90 days, a $250 license reinstatement fee, a $430 license reinstatement surcharge, and a $24 driver's license application fee. Those who refuse to take a chemical test when requested to do so by law enforcement are subject to a license suspension of one year. In order to get a restricted license after being convicted of a Minnesota DUI, a driver must install an ignition interlock device in his or her vehicle. Those who refuse to do so are prohibited from all driving privileges.
