Robbery and Aggravated Robbery Defined

According to Texas statute, robbery is a felony violation where a person commits theft and intentionally, knowingly or recklessly causes bodily injury or places another individual in fear of imminent bodily injury or death. This is considered a second degree felony offense.
Aggravated robbery is when a person commits robbery and additionally causes someone serious bodily injury by:
- using or exhibiting a deadly weapon
- threatening or placing another person in fear of bodily injury or death
If the person threatened is 65 years or older, or disabled this is categorized as a felony offense of the first degree. (By disabled it is meant that the individual has a mental, physical, or developmental disability and is substantially unable to protect himself from harm.)
When robbery is committed, unlike burglary, it almost always requires that a victim has suffered an actual injury or has been threatened with some sort of harm. A theft crime can easily turn into a robbery if the victim is injured or is threatened; the line is thin and if a weapon is used or even pretended, it becomes a more serious offense, namely aggravated robbery.
