If you are found to have a BAC that is .08% or higher, you will be arrested for boating while intoxicated (BWI). If you appear intoxicated but do not have a BAC of .08% or higher, you may also be subject to a drug test. Any refusal to take the breathalyzer test can result in a suspension of your license.
In Texas, boating while intoxicated is a misdemeanor and can result in a minimum of 72 hours in jail and up to 180 days. There are also heavy fines for a BWI conviction. Having a criminal record may also make your insurance rates go up, cause discrimination against you if you are applying for a job, make it difficult to rent a home or apartment, and make it less likely that you will be approved for a loan.
