Under Texas Law, if you are involved in an automobile accident with another vehicle or a pedestrian, you must remain at the scene of the accident, or return to it immediately if your vehicle did not stop during the accident. In accidents where the owner of the property or other vehicle is not there, you are required by law to leave accurate contact information and insurance information. An anonymous apology note does not suffice. A hit and run charge is one in which the operator of the vehicle in question does not stop or return, and thus does not take any responsibility for the accident.
A hit and run charge can be very serious. If there was an injury or death, it is a third degree felony and you could be sentenced to up to five years in prison and face a $5,000 charge. Even a hit and run accident that only involves property damage can be serious, though. A hit and run charge can also be coupled with a charge such as DWI, reckless driving, or vehicular manslaughter. Hit and run drivers are, if found, more often charged with DWI than drivers who stay at the scene.
If you are in an accident and do not stay at the scene, and are not arrested that same day, it is still possible that you can be charged with a hit and run. Security cameras and eyewitnesses can often identify cars and their owners. Even if you have not yet been charged, it is in your best interest to discuss your case with an experienced attorney.
