Shoplifting is one of the most common criminal charges in Florida and the nation. This crime generally involves stealing merchandise from a retail store. Florida law defines it as stealing "merchandise, property, money, or negotiable documents." This crime also involves removing or altering a price tag or label on merchandise or moving merchandise from one container to another. Anyone working in a retail store has the right to stop and detain anyone they suspect of shoplifting, providing they have reason to believe a crime was committed.
If arrested for shoplifting, the person accused will be charged according to the value of the merchandise stolen. Less than $100 worth of goods is generally charged as a second-degree misdemeanor, punishable by up to 60 days in jail and a fine of up to $500. Goods valued between $100 and $299 are charged as first-degree misdemeanors, punishable by up to one year in jail and a fine of up to $1,000. Those convicted may also be required to pay restitution. Property stolen which is valued above $300 is generally charged as grand theft felony with more serious penalties.
