Maker of Four Loko Gets Sued For Fraud Once Again

Four Loko is an alcoholic beverage produced by Phusion Projects that is now back in the courts with a new lawsuit; this time involving a potential class action suit. The suit was filed March 4th in California and claims that Four Loko customers were misled about how potent the caffeinated beverages were by distracting and colorful packaging, using fruit flavors and even strategically placing the beverages on store shelves suggesting they were similar to non-alcoholic drinks.
The Drinks Themselves
The original drinks which came in 23.5 ounce size cans had caffeine and guarana, both stimulants, as well as the alcohol equivalent of 3-4 beers. The drink which was originally launched in 2005 was linked to several deaths and alcohol poisoning. It was referred to by some as "blackout in a can." An FDA warning in November of last year forced Phusion to reformulate Four Loko without caffeine. Phusion feels the lawsuit is without merit and they claim to have always been upfront about the labeling of their ingredients.
