According to the National Survey on Drug Use and Health 2010, published by the U.S. Department of Health and Human Services, 2.4 million people aged 12 and above used marijuana for the first time in 2010. This translates to an average of 6,600 new users per day. Although the number of new users in this group remained relatively the same as from earlier years, new users in the age group of 26 and above had a substantial spike during the years of 2009 and 2010, from 49,000 to 247,000.
In California, the Center on Juvenile and Criminal Justice in its November 2011 drug policy update, reports that misdemeanor marijuana arrests are skyrocketing. The report states that arrests for almost every criminal offense in California, such as robbery, burglary, rape, and murder, have declined since 1990 except for marijuana possession arrests. An arrest for possession of one ounce or less is a misdemeanor punishable by a fine of up to $100. A conviction of possession of more than an ounce carries penalties of up to six months in jail and fines of up to $500.
