Domestic Violence Laws in Rhode Island

Like other states in the nation, Rhode Island has enacted laws pertaining to domestic violence. These laws define what is considered to be domestic violence between spouses, ex-spouses, cohabitants, dating partners, and family members. Courts will determine domestic violence based on the following factors:
- How long the relationship between the persons involved has lasted;
- What type of relationship it is;
- How frequently the persons involved have interacted with one another;
- Attempting to cause or actually causing physical harm;
- Putting the victim in fear of imminent physical harm;
- Making the victim engage in involuntary sexual relations whether through force, threat of force, or duress;
- Engaging in stalking or cyberstalking.
Stalking is defined as harassing the victim willfully or maliciously, such as repeatedly following the victim with the intention of putting the person in fear of being harmed. Cyberstalking refers to using a computer to harass a victim through its electronic means. Harassing is defined as conduct which is done knowingly and willingly to seriously annoy, alarm, or bother the victim which has no legitimate purpose and which results in the victim's emotional duress or fear of bodily harm.
Depending on the nature of the domestic abuse, the accused may be charged with a misdemeanor or a felony. The most common domestic violence charges in Rhode Island consist of assault and battery.
