The state of Arizona has some of the strictest mandatory minimum sentencing penalties relating to
drug offenses in the entire United States. The overall crackdown on drug use, manufacturing and sales has been the motivation for the tougher drug penalties. The majority of drug crimes in Arizona are charged as felonies and prosecutors will also attempt to sentence most first and second time offenders of drug possession to mandatory probation. A person may qualify for other types of sentencing programs such as drug court, diversion or deferred prosecution. These give the offender the chance to clear the criminal record after completing the requirements in the program or sentence delivered by the court.
