Illinois is among the 39 states which ban texting while driving. The texting while driving law went into effect in Illinois in January, 2010 as part of the Illinois Vehicle Code. The law prohibits texting, instant messaging, emailing, or surfing the web while driving and refers to both cell phones and laptop computers. It carries a fine of up to $1,000 and is considered a moving violation, which means that those convicted of the offense will accumulate points to their driving record. Enough points accumulated on your driving record over a certain time period can result in a license suspension. For individuals over 21, three moving violations in a year can result in a suspended license; for those under 21, it only takes two such violations.
Other Illinois laws regarding cell phones include a prohibition against both handheld and hands-free cell phone usage by bus drivers and novice drivers as well as a ban on using cell phones while driving in a school zone or in a construction area of a highway. Novice drivers are defined as those under the age of 19. Studies have shown that when a driver looks away from the road while texting, it compares to driving 4.6 seconds blindfolded, which translates to an entire football field. Recent national cases involving texting while driving include a landmark case in Massachusetts in 2012 where a teenager was sentenced to spend a year in jail and lose his license for 15 years due to a fatal accident he was involved in while texting.
