A felony DWI is a serious criminal charge in Texas. This charge can be levied against those arrested for drunk driving who have two or more prior convictions of driving while intoxicated or a prior conviction of intoxication manslaughter. It can also be charged if you are arrested for driving while intoxicated with a minor under the age 15 in the vehicle at the time of your arrest. If you are involved in a serious accident in which someone else is injured or killed due to driving while intoxicated, you also face the prospect of being charged with a felony DWI.
The penalties for a felony DWI conviction are severe. They include imprisonment, heavy fines and court costs, the suspension of your driver's license, and vehicle impoundment. Other restrictive conditions also may be included, such as ignition interlock devices. Bond conditions also may be very restrictive, such as house arrest, alcohol testing, and curfews. A third offense DWI is charged as a third-degree felony with fines of up to $10,000 and a prison term of 2 to 10 years along with a 2-year license suspension. If ordered to install an ignition interlock device on your vehicle once you are allowed to drive again, you will have to pay for the installation and monthly maintenance of the device yourself.
