Doctor Avoids Drug Conviction in Kingston

Intervention Ordered In Lieu of Prison For Marijuana Possession

Doctor Franklin D. DeMint was initially charged with a felony drug possession in 2009 when investigators found a half-pound of marijuana in his home in August, reports the Chillicothe Gazette.

The investigation was part of a crackdown by the U.S. Major Crimes Task Force all across the state. Law enforcement officials discovered over 6 pounds of marijuana growing on and around the property, though this was later determined to belong to another nearby cultivator unconnected to the doctor. After his indictment, DeMint voluntarily relinquished his medical license and began a 29-day inpatient treatment course.

After reviewing his case, the court ordered that DeMint undergo an intervention program, which entails that he continue treatment and abide by a strict set of guidelines for up to one year or until he is declared rehabilitated. The terms of the intervention also stipulate that he must perform 150 hours of community service, of which 20 must be spent giving drug lectures.

Medical Board Insists On Good Behavior

The Ohio Medical Board sets out a strict set of guidelines for medical practitioners found in violation of drug laws, which DeMint has followed to the letter. Due in part to his model conduct, his license was reinstated by the board in March 2010, on the condition that he remain drug free, obey all medical practice laws, and meet with the medical board every three months.

According to Ross County prosecutor Matt Schmidt, the terms set by the board are actually harsher than those imposed by the court for his intervention program.

DeMint also undergoes frequent drug testing. He had been a regular user of marijuana before the conviction, claiming to have smoked one or two joints every evening since 1997.
