Most people are familiar with the problem of forged checks; the techniques for check forgery have become more sophisticated as time has passed, but there are many other forms of forgery. If one creates, alters or forges a document with the intention of committing fraud or making money, it can be considered forgery and either state or federal laws and penalties come into play.
Different Types of Forgery
Forgery is a somewhat broad subject; following are some of the more common types to be found:
- Checks and money orders
- Titles
- Deeds
- Credit card applications
- Wills
- Trusts
- Securities
- Currency
- Bonds
- Corporate documents
- Court seals
A person can even be charged with forgery if they are in possession of an instrument that is forged (driver's license, ID card, etc that has been altered). Designer clothing and accessories are targets for forgery as are works of art, jewelry and literary works.
What Are the Penalties for Forgery?
The penalties for forgery can vary depending upon the several different factors. For example, how severe the crime was, how far reaching it was and whether it was committed in the state or on the national level. A forgery can be classified as a misdemeanor or felony. An experienced criminal defense lawyer is needed to assist you if you have been charged with fraud as they have the specialized knowledge to guide you through the criminal defense process and ensure your rights are protected. With a minor forgery a person may have to pay restitution to the person or persons who were victimized whereas a more serious forgery he may demand time spent in jail or prison. If a person is convicted of forgery, he will have this as a criminal felony offense on record.
