Criminal Hearing for Classroom Shooter Postponed in Ventura County

The Ventura County Star is reporting that the criminal hearing that had been scheduled for Brandon McInerney, a 15 year old, was postponed yesterday. The hearing was postponed by the judge overseeing the proceedings because Brandon's lawyers wanted time to appeal a decision, made by Superior Court Judge Rebecca Riley, to reject their request for documents that showed how state prosecutors decide when a person should be tried as an adult instead of a
juvenile. The preliminary hearing has been postponed until March 17, 2009.
At this time, Brand McInerney is being tried in adult court for the killing of his classmate, 15 year old Larry King. It is alleged that Brandon shot King on February 10th while they were attending E.O. Green School, which is located in Oxnard County. It is also alleged that Brandon chose to commit murder because of King's homosexuality.
Brandon's defense attorneys are arguing that he should not be tried as an adult as he just recently turned 15. They argue that there has been an abuse of discretion by the prosecutors who charged Brandon as an adult. His criminal defense lawyers allege that prosecutors did not fully review the individual circumstances surrounding the case, or even examine Brandon's home environment or educational background.
If he is convicted, Brandon McInerney will face 51 years to life in prison for his crimes, which include
murder and
hate crime offenses. He remains in police custody as his bail had been set for $771,000.
