Types of Drug Crimes

State and federal laws describe the specific types of drug crimes and the penalties that may be imposed upon a conviction. These may range in severity from a minor marijuana possession charge all the way to a drug trafficking investigation involving federal law enforcement agencies such as the Drug Enforcement Administration (DEA) or Immigration and Customs Enforcement (ICE). Following is a partial list of drug crimes:
- Possession of an illegal drug
- Unlawful possession of a prescription drug
- Drug sale or distribution
- Drug trafficking
- Transportation of illegal drugs
- Marijuana cultivation
- Drug manufacturing
- Drug import/export/smuggling
- Prescription fraud
- Possession with the intent to sell or distribute
- Sale of drugs to a minor
- Driving under the influence of drugs, including over-the-counter medicine
The severity of a drug crime charge will be based primarily upon the nature of the offense (for example, possession as opposed to distribution) and the type and amount of drug involved. Drug offenses are crimes that involve controlled substances, which are regulated by the government. These may include illegal substances or those that may only be possessed with a valid prescription from a licensed physician: heroin, cocaine, marijuana, Oxycontin, hydrocodone, Xanax, ecstasy, methamphetamine and many others.
