Marietta Woman Arrested at DUI Checkpoint for Intoxication and Cocaine Possession
By Stahlman Law PC
A Murietta woman, M.S., was recently taken into custody at a DUI checkpoint and charged with several serious offenses. M.S., 34 years old, was stopped at a DUI checkpoint on South Cobb Drive and had been apparently observed swerving in the road prior to coming to the checkpoint. In speaking with one of the officers working the checkpoint and questioned about the swerving she said it was because she was texting while driving. The officer reported smelling a strong odor of alcohol on her breath and became suspicious. He said she also had bloodshot eyes and had admitted to drinking alcohol that evening. She was asked to step out of her vehicle, a late model sedan, and perform a breathalyzer test. The "Alco-sensor" registered 0.101 alcohol level and she allegedly failed six other field intoxication tests. She was then placed under arrest for driving under the influence of alcohol. Authorities searched her car and found an open container of tequila that was about one-third empty. A search of her purse revealed a straw with a white powdery substance and other paraphernalia that may have been drug related. The powder was later tested and found to be cocaine. She has been charged with failure to maintain a line, texting while driving, driving under the influence and felony possession of cocaine. She posted $5,000 bail and was released. Reports did not state whether or not a blood test was done to determine if M.S. had any cocaine or other drugs in her system. DUI and drug possession are serious charges so make sure you have a tough criminal defense lawyer in your corner.
Charged with drunk driving in Cobb County?
State laws require that drivers submit to chemical testing (breath test and/or blood test) if asked by an officer. Refusing this implied consent law results in the instant suspension of your driver's license. If you have been charged with driving under the influence of alcohol or drugs then you could be facing severe misdemeanor or felony penalties such as expensive fines and imprisonment. You need the help of a defender experienced in fighting DUI charges to have the best chance of avoiding a conviction.
