An Idaho man who was convicted of a 5th DUI in Idaho received a prison sentence of ten years for a felony charge of driving while under the influence of alcohol or drugs. The man will spend a minimum of two years of the sentence in a state prison with the remaining eight years indeterminate. He was arrested and charged after a witness reported him to law enforcement because of his erratic driving. The witness reported that the man had been seen weaving across the roadway, almost striking another vehicle. The judge in the case urged the Parole Board to not release the man until he had completed all treatment programs connected with his drinking problem.
In California, anyone who is convicted of a third or subsequent DUI conviction faces the prospect of having their driver's license revoked for ten years. A third DUI offense within ten years may be charged as a felony, as is a DUI that causes injury or death to another. Being convicted of a California felony DUI will likely result in a substantial state prison sentence and heavy financial repercussions. Those facing DUI charges in California should seek the services of an attorney who is experienced in all of the technicalities, science, and the law regarding this serious offense.

In California, a DUI charge will result in two separate processes. One is the criminal process for which you will face criminal conviction penalties. The other process is the administrative one connected with the DMV, who will automatically suspend your license following a DUI arrest. To challenge the automatic suspension, you must request a hearing with a DMV official within ten days of your arrest or forfeit your right altogether.
