Murder Suspect Taken by Texas Law Enforcement

An Oklahoma man suspected of killing his mother and kidnapping his six year-old son was captured by local police in Lewisville, Texas. The 38 year-old man apparently argued with his mother at her home in a suburb outside of Tulsa. His mother had custody of the boy. He then shot and killed her, took the boy, and fled to Texas where he was tracked to a room in a Fairfield Inn. A SWAT team talked the man out of the hotel without incident and took him into custody. The man's son was inside in the lobby unharmed.
According to family members, the suspect suffers from mental health issues and has not been taking prescribed medication for his condition. He now faces charges of first-degree murder and kidnapping.
In Texas, the terms first-degree and second-degree are not used regarding murder. Under Texas law, four types of criminal homicide exist which are 1) murder 2) capital murder 3) manslaughter 4) criminally negligent homicide. Murder involves intentionally or knowingly causing the death of another, is charged as a first-degree felony, and is punishable by five to 99 years in prison or life in prison.
Capital murder involves killing a peace officer or fireman doing his duty, killing someone while committing another crime such as kidnapping or robbery, murdering someone for pay, killing more than one person as part of one scheme, or killing a child under the age of six. Capital murder may be punished by life in prison or the death penalty.
