Domestic battery is a common charge that is filed by the prosecution in cases where domestic violence has been reported by law enforcement. Under Illinois law, domestic battery occurs when an individual knowingly causes physical harm to a spouse, ex-spouse, domestic partner, or any family member. Aggravated domestic battery is charged when such physical abuse causes disability or disfigurement to the victim. Other situations which can aggravate a domestic battery charge are previous convictions of the offense, engaging in domestic battery in the presence of children, or violating an existing restraining order in which domestic abuse has been prohibited.
Generally domestic battery is charged as a Class A misdemeanor, which is punishable by fines of up to $2,500 and up to one year in jail. When Aggravated Domestic Battery is charged, it is charged as a Class 2 felony, which carries potential penalties of fines up to $25,000 and up to 7 years in a state prison. It is also a crime in Illinois to prevent someone or try to prevent someone from reporting domestic violence, including interfering with a family member who is attempting to tell a law enforcement officer about such an incident.
