July 17th marked the start of a new police policy which holds gang members in custody for longer periods of time. In just the few weeks since its inception over 1,300 alleged Chicago area gang members have been arrested and kept in jail up to 48 hours. The new policy states that individuals arrested for a misdemeanor gang crime be required to pay a cash bond in order to be released. It is hoped that by denying no-cash bonds to suspected gang members who have been taken into custody it will allow a "cooling off period" which may prevent continued gang violence or retaliation. Get the help of a qualified criminal defense attorney if you have been charged with a gang crime or other violent offense.
Ordinarily when someone is booked for a suspected crime that individual is either released on their own recognizance or required to post some sort of bond which is meant to guarantee that they will appear at court after being released from police custody. The bond can either be a cash amount or sometimes physical property is held for the bond instead. The bond amount in a misdemeanor gang crime case is usually low and may be easily put up through no-cash means. With the recent requirement, however, that bonds in these specific cases cannot be a no-cash bond, more individuals are being forced to remain behind bars until their court appearance.
