If you are facing an arrest and charges connected with drug crimes in Orange County or elsewhere in California, you may have legitimate legal defenses which can lead to reduced charges or winning your case in the courts. If your case appears to be impossible, with overwhelming evidence against you, you still may be able to avoid incarceration through a drug diversion program. Your criminal defense attorney may be able to negotiate a plea that places you in one of these alternatives which will consist of a drug treatment program instead of jail.
Proposition 36 is one of these programs, which was initiated in 2000. Under this program those facing a non-violent drug crime charge who successfully complete a court-approved drug treatment program will have their criminal charges or conviction waived. A non-violent drug crime generally means possession or transportation of controlled substances for one's own personal use. These substances may include marijuana, cocaine, heroin, methamphetamines, peyote, GHB, Ecstasy, and similar narcotics. It may also include certain prescription drugs, such as the most popular ones that are abused through unauthorized use, such as oxycodone and hydrocodone. Those defendants with previous violent or serious drug felonies are not eligible for Proposition 36 programs.
