Arrest Marks Latest In Slew Of Intoxicated Driving Charges For Suspect
After stopping a driver behaving erratically, a deputy with the Marion County Sheriff's Office arrested an elderly man on suspicion of driving under the influence. The officer was in the road directing traffic when he was nearly struck by the suspect, he later told reporters.
According to the police report filed by the Sheriff's Office, the deputy had been directing traffic at the intersection of State Road 200 and County Road 484 in the early hours of the morning on Monday, August 20th. A tree had fallen in the middle of the road, causing a traffic hazard, and the police officer was helping to direct drivers around the branches, which posed a potential threat in the dark.
At approximately 3:00 a.m., the deputy claims that a driver approached him at high speed and failed to slow down. He feared that the driver would collide with his patrol car, which had its emergency lights engaged, and he jumped out and began waving his hands and using his flashlight to stop the driver.

After getting the drivers attention, the report continues, the deputy watched as the car slowed down and came to a halt without incident. He then approached the vehicle and asked the driver some questions. It became apparent to the officer that the suspect was intoxicated, he said in the report.
The man allegedly told the law enforcement officer that he was trying to find a McDonalds. When asked to get out of the car and perform some field sobriety tests, he was unable to complete them to the officer's satisfaction. Finally, deputy took the man into custody, where he was given a blood alcohol test, registering a .092, above the legal limit of .08 percent.
This arrest marks the suspect's fifth arrest for driving under the influence of alcohol in eight year. The other arrests occurred over a period from 2004 to 2010, the report alleges. It is unclear if the man was convicted of any of these charges, which would have an effect on the potential sentence he could face.
