Last month in Fort Myers, a local police officer was charged with domestic violence for allegedly assaulting his former girlfriend. Officer Joseph Martinez was arrested and charged with domestic battery by strangulation and domestic violence battery according to a spokesperson for the Fort Myers Police.
He apparently got into a heated argument with the former girlfriend which led to the incident. Officer Martinez was placed under arrest at the police headquarters and taken into Lee County jail. The police chief made a statement that this was not the conduct expected from one of their own officers and Joseph Martinez was placed on administrative leave until the outcome of the criminal and internal affairs investigation is complete.
Take Action
If you have been accused of a domestic violence crime, you need to take action and get help from a criminal defense attorney. If a police officer receives a domestic violence call, his foremost position will be to take the accused to jail. In the event that the victim later takes back the accusation, it is up to a prosecutor to dismiss the charges, not the victim, which can create even more delays and problems. If the accusation was false stemming from a partner's wish to destroy the reputation of the other, then a strong defense is going to be necessary to bring out the truth. It could also be that the accused was defending him/her self and wrongly accused of domestic violence.
Whatever the circumstance, if you are in the Fort Myers area and have been accused of domestic violence, you need to contact a Fort Myers domestic violence attorney quickly to protect your freedom and avoid a conviction.
