Child Endangerment Laws in New York

After she kicked her two daughters, aged 10 and 12, out of the car, the oldest one caught up with her and was allowed back in. The younger one wandered around distraught and was picked up by police who were alerted by a Good Samaritan. When the mother was called to come and pick up her younger daughter at the police station where she was being safely held, the mother was charged with misdemeanor child endangerment.
Under New York Penal Code Section 260.10 child endangerment is defined as knowingly acting in a manner “likely to be injurious to the physical, mental, or moral welfare of a child less than 17 years old or directs or authorizes such child to engage in an occupation involving a substantial risk of danger to his life or health.” Child endangerment also consists of failing or refusing to exercise “reasonable diligence in the control” of a child so as to prevent him from becoming abused, neglected, a juvenile delinquent, or in need of supervision, according to the terms of a Family Court. Child endangerment in New York is charged as a Class A misdemeanor.
