In the state of Virginia, all drivers are required to have a current Virginia driver's license in order to operate a motor vehicle with the following exceptions: people who operate farm equipment, nonresidents who are legally licensed in another state, certain exemptions for members of the armed forces, certain nonresidents who are lawfully licensed in a foreign country, and new residents of Virginia who are lawfully licensed in another state and are protected under the 60 day grace period. Driving without a license in Virginia is a Class 2 misdemeanor. The penalties for unlawfully driving without a license in Virginia are up $1,500 in fines and up to 6 months in jail. A second or a subsequent violation of driving without a license is charged as a Class 1 misdemeanor offense. Additionally, a person who is caught driving without a license is subject to having their vehicle impounded or immobilized for a period up to 90 days upon conviction. However, if the offender was driving a motor vehicle belonging to another person, then the courts will not order the motor vehicle to be impounded or otherwise immobilized.
