6th DWI Conviction Results in Life Sentence

By Martinez Law Firm October 23, 2013

A woman charged with a sixth Driving while Intoxicated offense was recently sentenced to spend the rest of her life behind bars. The conviction comes after a July 2012 incident in which R.D., 44 years old, was arrested. A police officer stated in arrest reports that he observed a vehicle drifting between lanes and maneuvering erratically. The officer turned on his emergency lights and conducted a traffic stop. The vehicle pulled over and the officer went to the driver's side to speak with whoever was behind the wheel. He talked to R.D. and then noticed an open beverage container. Reports state that the open container turned out to be beer. The police officer took the woman into custody and she was subsequently charged for DWI and other offenses. An investigator became involved when it became known that the woman had five prior DWI convictions, the first being in 1996 when she was approximately 27 years old. She had been incarcerated on all of her previous conviction so the judge apparently felt it was time to send a strong message and sentence her to life in prison. Make sure your rights and freedom are aggressively defended by seeking the representation of a tough criminal defense lawyer skilled in handling DWI cases.

About Drunk Driving and DWI of Drugs Charges

Whether an intoxicated driver is charged with misdemeanor or felony DWI depends on a number of factors. A first time DWI that doesn't involve any accident or injury may be a misdemeanor offense while the same circumstances at the time of an arrest coming after the individual has previously been convicted for DWI may result in felony charges. Other determining factors include things such as how far over the 0.08 percent blood alcohol content limit the driver was, if there were young minors in the car (child endangerment), accidents involving injury or fatality, etc. Penalties are severe involving incarceration for 24 hours up to many years behind bars, hundreds to thousands in fines, loss of your driver's license and more.
