Marijuana Laws in Texas

In some states, such as Washington and Colorado, the recreational use of marijuana has been decriminalized. In other states, such as California, medical marijuana has been legalized. In Texas, however, the possession and use of marijuana in any circumstances is still illegal, applicable even if you are visiting from a state where it is not a crime. This means that those found in possession of any quantity of the drug can be charged and prosecuted. How you will be charged depends on the quantity found. Quantities under a pound are punishable by jail or prison sentences of six months to two years and fines between $2,000 and $10,000. Those convicted of this particular quantity of the drug, however, will receive probation under which a drug treatment program is ordered and fines may be waived by the court.

Those convicted for possession of one to five pounds of the drug will not be eligible for probation as above; they will receive a minimum sentence of six months and may be charged with a state jail felony. This means that you will have a felony record which can pose problems for you in the future with employment, career advances, educational opportunities, and more. Those convicted of possessing quantities larger than five pounds will generally be viewed as drug traffickers and will face much harsher penalties.
