If you have been charged with kidnapping, one of the wisest actions you could take is to contact a criminal defense attorney who has experience in this type of defense. Serious consequences can result from being convicted of kidnapping and this can negatively affect your future in numerous ways.

Having a criminal record can affect your ability to get employment, housing, and financial opportunities. This is something you want to avoid at all costs. If you are imprisoned, this will further affect your life in terms of personal relationships, income, and the possibility of having to pay heavy fines. Getting competent legal representation is crucial to your freedom.

Types of Kidnapping

Kidnapping is the illegal action of taking someone against their will or, if the person being kidnapped is a child, taking him or her away from their custodial parent or legal guardian to some other location. In many instances, a person is forced, threatened or in some other manner coerced into leaving, then is forced to stay in the new location.

With children it can be different in that one parent or person may use persuasion to lure the child away from their legal guardian or parent. This is still kidnapping in the eyes of the law. If a parent breaks an earlier court order that is in force and kidnaps his own child, serious consequences can result. Following is an explanation of some different types of kidnapping charges:

  • Kidnapping: If you abduct someone knowingly and intentionally.
  • Unlawful Restraint: If you knowingly and intentionally restrain another person.
  • Unlawful Transport: If you unlawfully transport another individual in exchange for money and try to hide the fact from authorities, and if you endanger that person's life, you can be charged with this state felony.
  • Aggravated Kidnapping: If you abduct another person knowingly and intentionally in order to exchange them for ransom, harm them, or use them as a hostage; this is considered a felony offense.
