Explanation of Family/Domestic Violence

In the state of Texas, domestic violence is referred to as either family violence or domestic violence. According to the Texas Penal Code and Family Code, a person commits domestic assault if they "intentionally, knowingly or recklessly cause bodily injury" to a family or household member. Domestic violence covers a broad spectrum of different types of family violence and also includes intimate partner violence (IPV). Some examples of Family/Domestic violence are:

  • Violence or physical abuse directed towards your spouse or domestic partner
  • Child Abuse
  • Violence committed by one member of the family or household against another

Domestic violence takes on many shapes and forms and describes a pattern of abusive behaviors directed towards one's spouse, child, intimate partner or other family member. Violent behaviors such as hitting, punching, slapping, kicking, biting, restraining, throwing objects, sexual abuse, emotional abuse, intimidation, threats, stalking and economic deprivation are all categorized under family/domestic abuse.

Repercussions of Domestic Violence

An individual can be charged with assault if they knowingly or intentionally cause bodily injury to another person. Under Texas law, this type of assault charge is considered domestic violence when the victim is a spouse, a former spouse, a child, a family member, a co-parent or someone with whom you are in a romantic relationship.

Protective orders may be issued after a conviction which may bar contact from the victim for up to two years which may affect your ability to return home. There are also restrictions imposed on the ability to own a firearm for up to five years for anyone convicted of domestic assault in the state of Texas even if it was a misdemeanor. Domestic assault is a misdemeanor for a first time offender and the sentence may include up to one year in jail and a fine of up to $4,000. A second conviction is considered a 3rd degree felony and may include a sentence from 2 to 10 years in a state penitentiary.
