DWI’s in Texas

It is against the law in all states to be driving under the influence of alcohol with a blood alcohol concentration (BAC) over 0.08 percent or more. A first DWI conviction is a Class B Misdemeanor offense in the state of Texas. The penalties for a first time DWI offense are:
- Minimum of 72 hours in jail, up to 6 days if an open container was present
- Up to $2000 in fines
- DWI surcharge on top of other fines. $1000 per year, for three years for a first DWI offense.
- Up to one year driver's license suspension
- Completion of a 12 hour DWI Education Program
- Probation
- 24-100 hours of community service
Penalties for a Second Texas DWI offense:
- Class A Misdemeanor
- 72 hours to 1 year in jail
- Up to $4000 in fines
- DWI surcharge on top of other fines. $1,500 per year for three years for a second DWI offense. That fee increases to $2000 per year if the driver's BAC was more than the legal limit.
- 180 days to 2 years driver's license suspension
- Completion of a 12 hour DWI Education Program
- Probation
- 24-100 hours of community service
