Stalking as a California Domestic Violence Crime

The Stalking Resource Center estimates that 1 in 12 women and 1 in 45 men will be victims of stalking at some point in their lifetime. The majority of these victims know their stalker. Stalking can consist of such actions as repeatedly following the victim, making unwanted phone calls, sending unwanted letters or emails, vandalizing the personal property of the victim, threatening to harm or kill a family pet, threatening to harm another family member, and similar behavior.
Further statistics issued by the Stalking Resource Center show that 87 percent of stalkers are men. When it comes to women as stalking victims, 59 percent of them are stalked by an intimate partner. 81 percent of these women become victims of physical assault from their stalkers. The average length of time a person is stalked is 1.8 years except in cases where the stalker is an intimate partner which lengthens the duration to 2.2 years. Surprisingly, only 28 percent of women stalking victims obtain a restraining order and only 10 percent of male victims do so. Another surprising statistic revealed by the Stalking Resource Center showed that restraining orders were violated in 69 percent of female victim cases and 81 percent of male victim cases. In California, stalking is covered under Section 646.9 of the California Penal Code. It is defined as willfully or maliciously and repeatedly harassing someone to the point where the victim fears for his or her safety or the safety of other family members.
