One of the co-founders of Pinkberry, the frozen yogurt franchise, was recently found guilty by a jury in the beating of a homeless man in Los Angeles. The convicted man, Y. L., was convicted of assault with a deadly weapon in the 2011 incident which involved the use of a tire iron. He was apparently approached by the victim near an off-ramp of the 101 freeway and shown an offensive tattoo which he considered a sign of disrespect. He later returned with another man to beat the victim, who sustained great bodily injury. Y. L. now faces up to seven years in prison when he appears for sentencing in January of next year.
Assault with a deadly weapon is covered under California's Penal Code 245(a)(1) which defines it as assaulting someone with a deadly weapon or with other means likely to cause great bodily injury. This offense may be charged as a misdemeanor or felony, depending on what kind of weapon or instrument was used in the commission of the crime, what kind of injuries the victim suffered as a result, and who the victim was. Depending on the nature of the offense, the penalties can include informal probation, one year in a county jail or 2 to 4 fours in a state prison, $10,000 in fines, a possible "strike" on your criminal record, restitution to the victim, confiscation of the weapon used, community service, and anger management classes.
