Tennessee Cop Accused of Child Pornography

By The Bowlin Law Firm  Sep. 3, 2013 3:00p

A cop who worked for the Greeneville Police Department in Tennessee has been charged with two federal felony counts of receiving and possessing child pornography. The auxiliary police officer was arrested last week in connection with the charges after it was found that he had made several searches for child pornography of underage girls on the laptop computer in his patrol car. The images included pictures of nude girls and pornography of girls as young as those in the fifth grade. Child pornography images were also allegedly found on the 45 year-old ex-cop's computer. The ex-cop had worked for the Greeneville P.D. part-time since 2000.

Under federal law concerning child pornography, the legal definition of this offense does not require that the images show a child engaging in sexual activity. It can include pictures of naked children if they are presented in a sexually suggestive manner. It involves any minor under the age of 18 that shows sexually explicit conduct. Child pornography which involves the internet generally falls under federal jurisdiction and is a serious crime which carries penalties of 5 to 30 years in prison, depending on the nature of the crime. Harsher penalties may apply if the convicted person has previous convictions or if the crime was an aggravated offense, such as one involving the actual sexual abuse of a minor or images which are particularly violent or sadistic. Those facing federal child pornography charges may also be prosecuted under state laws as well.
