Kentucky Manufacturing Methamphetamine Laws

Under Kentucky law, a person can be convicted of manufacturing methamphetamine if he "knowingly and unlawfully" creates and produces the drug or if he possesses two or more chemicals or two or more items of equipment used to manufacture the drug. This drug crime is charged as a Class B felony on a first offense and a Class A felony for a second or subsequent offense. Class B felonies in Kentucky carry penalties of at least 10 but not more than 20 years in prison. Class A felonies are punishable by 20 to 50 years or life in prison. Making methamphetamine in the presence of a child is also a crime in Kentucky which is generally charged as a felony carrying a penalty of one year up to life in prison. More severe sentences are given if a child is injured or dies due to being present during the manufacture.
Because of the growing use and abuse of methamphetamine in Kentucky, law enforcement task forces have been created to identify, find, and prosecute those who violate drug manufacturing laws in the state. In October of this year, a multi-agency investigation in Graves County, Kentucky resulted in the arrests of five people and the seizure of many pounds of crystal methamphetamine along with numerous weapons. Further searches and seizures of property used by the defendants netted a total amount of drugs valued at $2,400,900. The defendants face various drug charges from federal trafficking to possession.
