If you have been charged with aggravated assault, you may have lots of questions for your Dallas criminal defense attorney. Some of your questions may center on how your attorney will represent you and how they plan to mount your defense.

There are several defense strategies that Dallas criminal lawyers will likely take. One common strategy is to try to illustrate that your alleged victim’s injuries are not as serious as the prosecution has made them out to be. This can be done by asking the victim questions on cross-examination. Oftentimes, the victim’s answers may actually end up helping your case.

For example, the prosecution may have asked questions that illustrated the severity or the pain resulting from the injuries they sustained. Your lawyer may want to ask these follow-up questions that will clarify the injuries to the jury:

  • Were you able to call the ambulance yourself?
  • Were you able to get up off the floor unassisted?
  • Did you think you needed medical treatment right away?
  • Where did you experience pain right after the incident?

Your lawyer may also want to ask more questions about the nature of the treatment the victim received. That’s why your lawyer may ask:

  • How long did you stay in the hospital?
  • What type of treatment did you receive?
  • Were you treated in the ambulance by paramedics?
  • What was the diagnosis that was given by the doctors?
  • Were you prescribed any medication?
  • Were you given follow-up appointments?

Lastly, your lawyer may want to find out if the victim has suffered any residual injuries. Or, if the injuries have healed:

  • Were you able to go to work after the incident?
  • Did you have to go see a specialist after you were released from the hospital?
  • Are you still able to exercise? Is this more or less than before your injuries?
  • Have you been told by medical professionals to restrict your activities in anyway?
  • Are you able to drive on your own?
  • Can you lift objects?
  • Are you able to cook and clean on your own?
  • Are you currently able to play with your children?

Some Dallas criminal attorneys may choose to ask different questions. It all depends on their defense strategy. It may also depend on the specific case that you have.
