Gang Assault in New York City Carries Harsh Penalties

Being convicted for gang assault is a more serious than being convicted of regular assault. If you were involved in an assault with two or more other people, you can be charged with gang assault, even though you may not be a member of a gang. The charge relates to multiple people acting together in the assault and is covered in the New York Penal Code section 120.06 and 120.07. The following example happened in 2009 and just two months ago, another arrest occurred in relation to the assault.
Gang Assault at TriBeCa
In 2009, a gang assault occurred at the TriBeCa Independent Plaza Complex in which a 26 year old man was severely beaten by at least five men. They were screaming anti-gay slurs while carrying out the beating. The victim suffered a scratched cornea, broken nose and five broken teeth according to a New York Post article. All involved in the gang assault were friends and four were arrested, one who is currently serving time. Most recently, a fifth arrest occurred two months ago in March 2011, 22 year old E. G., who was charged with gang assault and assault as a hate crime relating to the same incident. He was bailed out of jail by his father, a former NYPD officer.
