When motor vehicle drivers are involved in any type of an accident with their vehicle, they are required to take responsibility. When drivers are in an accident, and then flee the scene, before leaving their information, looking to see if there was any property damage, or if somebody was hurt, then they are guilty of hit and run. Every state in our nation criminalized hit and run and in Texas, a person guilty of hit and run can be charged with either a misdemeanor or a felony offense, depending on the facts surrounding the case.
The term “hit and run” wouldn’t exist if it wasn’t a common occurrence. Although people have a moral and a legal obligation to stop after an accident and call local law enforcement, people don’t always do so. When people are involved in car accidents or pedestrian accidents, they might experience the “fight or flight” syndrome, where their initial reaction is to flee the scene of the accident, out of fear of what might come of them. When adrenaline is rushing, people don’t always make the most logical decisions, and history has shown this, hence the term “hit and run.” If you have been arrested for a hit and run, contact a Houston criminal defense attorney right away.
Keep in mind that when you are involved in an accident of any form, you are supposed to stop your vehicle. You are obligated to provide your identifying information such as your phone number, your driver’s license number, license plate number and your insurance information. You are also supposed to check for injuries. If somebody was hurt in the accident, an ambulance needs to be called. If you do not have a cell phone, you need to do what you can to get help. You are also supposed to call local law enforcement, so a police report can be made. If there was nobody around during the accident and you caused property damage, then you are supposed to leave a note with your contact information.
