Along with other drug laws in the state, the use or the possession with the intent to use drug paraphernalia in Kansas is also illegal. This includes drug paraphernalia used to "manufacture, cultivate, plant, propagate, harvest, test, analyze, or distribute" illegal drugs or used to "store, contain, conceal, inject, ingest, inhale or otherwise introduce" an illegal drug into a human body. In addition to this, it is also illegal for anyone to possess or manufacture with the intent to distribute or to distribute drug paraphernalia knowingly or in cases where one should know that the paraphernalia will be used in relation to illegal drugs.
Factors which are relevant to the determination of whether a crime has been committed in regards to drug paraphernalia include anything said by the owner or user of the paraphernalia, that person's prior convictions concerning state and federal drug laws, the proximity of the paraphernalia to any violations of state or federal drug laws, the proximity of the paraphernalia to the illegal drugs themselves, and the existence of any drug residue on or in the paraphernalia. Crimes involving drug paraphernalia may be charged as misdemeanors or felonies, depending on the circumstances. Where these crimes involve minors under the age of 18 or crimes within 1,000 feet of school property, they are treated more harshly.
