Like other states, Tennessee employs a complied consent law which means that you have agreed to submit to a chemical test should you be requested to take one by law enforcement when under suspicion of driving while under the influence of alcohol and / or drugs. The legal limit for blood alcohol concentration (BAC) in Tennessee is .08 percent. You can be charged and convicted of DUI if your BAC measures this amount or higher. Those convicted of DUI in Tennessee face jail time of 48 hours up to one year. Those convicted with a BAC of .20 percent or more will face 7 consecutive days in jail. You will also lose your license for one year, be ordered to participate in a drug or alcohol treatment program, be ordered to pay restitution to anyone whom you may have injured or who sustained personal losses, be fined $350 up to $1,500, and may be ordered to install and use an ignition interlock device in your car at your own expense. First-offense average costs for a DUI can be as high as $4,900 which includes towing, bail, attorney fees, high risk insurance coverage, court costs, DUI school, and license reinstatement fees. Repeat offenders will face more severe penalties.
