A man that had agreed to stay in at night, off the Internet and to have his movements monitored with an ankle device after being charged with possession of child pornography, did not keep to the court's orders and instead killed a woman and raped a young girl, as reported by the Huffington Post.
According to authorities, on March 14, D.R., 29, cut off his ankle monitor, carjacked a woman's vehicle, raped the woman's 10 year-old daughter, and then raped and stabbed the woman to death.
The mother, a librarian, and her daughter had just attended a gymnastics class at a mall together near Clay, 150 miles east of Albany, when D.R. abducted them.
According to troopers, both mother and daughter had been bound when D.R. allegedly raped the young girl. The girl was somehow able to escape and was assisted by a motorist that was driving by.
The same motorist, seeing a man running from the scene, alerted 911 dispatchers. Police swiftly responded by sending in both ground and air patrols. Within a short period of time D.R. was apprehended in a woody area.
Authorities have yet to establish when the girl's mother had been killed, and how the girl got away from D.R. Trooper J.K, told reporters, "We're still trying to piece the timeline together."
The mother's cause of death was due to multiple stab wounds. The girl was still under a doctor's care in the hospital as of press time.
In January D.R. was charged with possession of child pornography. He was permitted to be free, however, he was ordered to stay of the Internet, away from areas children congregate – such as schools, parks and arcades – and to wear an electronic monitoring device on his ankle.
According to authorities, after the arrest, D.R. lost his job at a supermarket, couldn't find another job and was forced to move into his mother's house.
It is believed that he removed his monitoring device shortly before the carjacking.
D.R. was arraigned on March 15 on charges of murder, rape and kidnapping – this time he was not given bail as an option.
At the time of his arrest on the pornography charges, FBI records should that D.R.'s North Syracuse apartment was searched and four computers were found – all with adult pornography D.R. admitted to viewing. However, Agent A.S. said that D.R. later admitted to downloading child pornography, for six years on at least one of the computers.
D.R. turned the computer over to the agents. It was found to have an encrypted hard drive and D.R. gave the agents the encryption key. Agents then found 100 gigabytes of child porn – equivalent to 500 videos and over 3,000 images.
As D.R. had no prior criminal record, he was released under the aforementioned guidelines: No Internet, not to leave his home at night, and not to go anywhere around children.
D.R. is now in federal custody.
