On February 23, a judge told Lindsay Lohan, 24, that she will face jail time if she attempts to bargain a plea for her theft charge, as reported by Reuters and TMZ.
Lohan, though, appeared to be considering rejecting any deals and taking her chances with a trial.
The actress has until March 10 to consider a plea deal that the prosecutors have offered her. Terms of the deal have not been disclosed.
She has been charged with the removal of a $2,500 necklace from a Los Angeles jewelry store without paying.
This was yet another visit to a Los Angeles courtroom by Lohan, whose previously thriving career on screen has been replaced with legal drama.
TMZ has alleged, via nameless sources, that prosecutors desire Lohan’s guilty plea as it will allow her only six months of jail time, and it may possibly alleviate a longer sentence for theft.
Last summer Lohan was confined to jail for two weeks – as she had violated her 2007 parole for her drunken driving and
cocaine conviction.
Judge Keith L. Schwartz told Lohan, “This case does involve jail time. Period. If you plead (guilty) in front of me and the case is resolved in front of me, you are going to jail, period. I get the impression you are not going to accept the (prosecutors') offer, okay. I don't have a crystal ball, and I'm not privy to any inside information, but that is the feeling that I got.”
Per TMZ Lohan told friends that she believed the necklace was on loan when she had pleaded not guilty to grant theft at the first hearing in early February.
It is also alleged, per TMZ, that Lohan told a friend when the court emptied out that she wasn’t guilty and would not, in her opinion, be going back to jail.
On March 10 Lohan must decide.
Schwartz continued, “I don't care that you are Lindsay Lohan versus John Doe, you will be treated exactly the same as anyone else, no better or worse.”
Lohan dressed only slightly more demurely this time as compared to her last court appearance. That time she displayed her legs in a mini dress; this time she chose to highlight her bust with a plunging neckline.
When it was time for Lohan to acknowledge that she understood all that had been said by the judge, she answered, “Yes, you’re honor.”
Lohan is still on probation for her 2007 drunk driving conviction and must appear before a different judge in another court hearing on that matter. Earlier this year, she completed a three-month long court-ordered rehabilitation.
It was her fifth time in rehab in the past three years.
Schwartz suggested to Lohan was that it might be time for her to see a psychologist for counseling. In his final warning the judge said, “I don't want you to be a repeat offender....I want you to get on with your life and move on.”
