Your Rights Protect You From Illegal Searches

When police conduct traffic stops, you do have certain rights that you should be aware of.

While there is no fast and steady rule as to whether an officer can search your car, there are cases when a search can be made. Should the officer have reasonable suspicion to think that you are armed, they can search and frisk your body for a weapon. They can also pat you down for illegal contraband, and this would not be considered an illegal search.

The Supreme Court recently heard a case that changed the way an officer can search your vehicle. An officer can search the passenger compartment only if you are within reaching distance of the compartment (ie you are in your own vehicle, not detained in the patrol car) or if they have reason to believe that you could have weapons (such as you have been detained before for firearm possession.)
