I am being charged with public intoxication and assault on a peace officer. What should I do? Should I talk to the cops and be cooperative or wait?

First, you should immediately speak with your attorney, or an attorney in your area to find out about how local and state laws will affect your case. You should be cooperative and polite with investigators, however you should NOT provide any information relevant to the case, other than your personally identifying information, without the presence of your attorney. This is your right, and you should absolutely take advantage of this to protect yourself. Since you are in L.A., feel free to contact me and we can discuss your case in person or over the phone.

Assaulting a police officer, even if you are drunk, is a serious offense and you will need an attorney to guide you through your case.Likely you are facing a misdemeanor charge, which in California can potentially result in up to a $2,000 fine and up to a year in jail, for the assault charge alone. Speak with an attorney BEFORE you talk about the case to anyone at all, and only do that when your attorney advises that it is okay to do so, in order to keep your rights protected.
