Carjacking in Los Angeles

Carjacking in California is a serious crime. Carjacking is a felony offense and the penalty is up to nine years in state prison plus additional prison time if a weapon was involved in the commission of the crime. Under the California Penal Code Section 215, "Carjacking is the taking of a vehicle from someone's immediate possession accomplished through force or fear." Carjacking is considered to be a violent crime. This means it counts as a strike under California's "Three Strikes Law. " If you have previous convictions, you could face 25 years to life in prison.

In order for you to be convicted, the prosecution will have to prove that:
- You took a motor vehicle that did not belong to you.
- You took the vehicle from somebody who was in it, either the driver or a passenger.
- You took the vehicle against that person's will.
- You used force or fear when you took the vehicle in order to prevent that person from resisting you.
- That you intended to deprive the other person of their vehicle either temporarily or permanently.
- That you showed "intent" to take the vehicle before using force or fear. If the "intent" to take the vehicle wasn't apparent until after using force or fear than you did not commit carjacking.
